This is retirement due to permanent incapacity for service or the death of the civil servant, provided such incapacity or
death is caused by accident or illness in service or as a result of it
Unless otherwise proven, in act of service will be defined as when the permanent disability or the death of the civil servant took place in the workplace and during working hours.
No period without coverage is required.
The extraordinary retirement pension is calculated by applying,
at 200 for 100 of the corresponding base pay, the percentage corresponding to the
years of service given, with the particularly feature that, as well as the years of service accredited to that day, the full years remaining before the civil servant reaches retirement age shall also be considered as effective service. They shall be understood as having been provided at the scale or in the force, post or job the party concerned is attached to at the time when the declaration of retirement occurs.
The calculation of this type of benefit shall be carried out in accordance with the criteria previously given for ordinary pensions, although the base shall be taken at
200 for 100 and the years remaining before the civil servant reaches compulsory retirement age shall be considered as effective service to the State, as well as those accredited to that date. They shall be understood as having been provided at the scale or in the force, post, job or category to which the person was attached at the time of death.
It is always made ex parte: the civil servant retired due to permanent disability for service, or the relatives of the deceased civil servant regarded as having an entitlement to an extraordinary pension, should ask the retirement organ to initiate the proceedings to ascertain the determining causes and circumstances that concurred in the retirement or the death of the civil servant.
Once the application has been received, the retirement organ will appoint a proceedings examiner, who will proceed -ex officio or at the request of the interested party- to examine the evidence to ascertain the relevance of the lesions or ailments that determined the retirement due to permanent disability or the death of the civil servant, as well as the relationship of causality between them and the service or department or task performed by the interested party.
Once the proceedings have been concluded, the instructor will meet the interested party and will form a proposal for a solution, and will make a pronouncement on the proven facts and the relationship of causality between the lesions or the death and the service or department or task performed by the interested party.
The full proceedings will be sent to the retirement organ for the latter to issue a report on the recognition of the extraordinary pension and send it, together with the proceedings of ascertainment of the cause to the General Directorate of Personnel Costs and Public Pensions for a definitive finding.
