Retirement departments

The following bodies are responsible for handling procedures and declaring retirements under the State Passive Class System for:

Bodies or Scales of the Public Administration

In active service

*Compulsory retirement by reason of age or permanent disability for service:

  • The Under-Secretarary of the Ministerial Department in whose central services, organizations or dependent bodies the civil servant works;
  • The Government Delegate or Subdelegate, when the civil servant works for peripheral services, on a regional or provincial level, respectively.

*Voluntary retirement:

  • The Under-Secretarary of the Ministerial Department when the civil servant belongs to the Bodies or Scales attached to the Department itself;
  • The Director-General of Public Functions in the case of civil servants belonging to Bodies or Scales attached to the Ministry of the President's Office and dependent organizations of the Secretary of State for the Public Administration.

*Early voluntary retirement (article 34 of Law 30/1984):

  • Director-General of Public Functions.

In a situation other than active service

*Retirement, regardless of its nature, except in the Autonomous Communities:

  • The Under-Secretarary of the Ministerial Department in which the interested party last rendered service as a civil servant in active servicectivo.

*Retirement, regardless of its nature, in the Autonomous Communities:

  • The body determined by the Autonomous Community in question.

Bodies or Scales of the Justice Administration

*Retirement, regardless of its nature, independently of the official's administrative situation:

  • The General Board of Judicial Power if the civil servant pertains to the judiciardicial.
  • The State Secretary of Justice, if the civil servant works as a public prosecutor, is a Lawyer of the Administration of Justice, or if s/he holds any other Profession or Grade of the Administration of Justice.

*Retirement, regardless of its nature, of Property Registrars:

  • The Director-General of Registers and Notaries.

Civil servants in the Parliament or other constitutional organsitucionales

*Retirement, regardless of its nature, irrespective of the official's administrative situation and place of employment at time of retirement:

  • The competent administrative services of the Parliament or other constitutional organs.

Civil servants in University Teaching Bodies

*Retirement, regardless of its nature, irrespective of the official's administrative situation:

  • The Dean of the University where the civil servant was last employed.

of Property Registrars

*Retirement, whatever its nature:

      •  Director General of Registries and Notary Publics.

INITIATION OF THE PROCEDURE FOR RECOGNITION OF RETIREMENT PENSION RIGHTS

Resolution of 18 March 2010, of the Directorate-General for Personnel Costs and State Pensions governs the electronic processing of the "J" form for initiation of the procedure for granting retirement pensions to civil servants under the Passive Class System by way of the JUBIL@ application.

JUBIL@ makes it easier for retirement agencies to complete the electronic certification of data relating to retiring civil servants, and to send these data online to the Directorate-General of Personnel Costs and State Pensions, for their automatic entry to the information system granting Passive Class pensions. From 9 July 2010 all forms "J" have mandatorily send for JUBIL@
