Advances on the Food Guarantee Fund

The Alimony Payment Guarantee Fund, created by Law 42/2006, of 28 December, and regulated by Royal Decree 1618/2007, of 7 December, is a fund that lacks legal personality, whose purpose is to guarantee children who are minors the payment of recognised but unpaid alimonies established in a legally approved agreement or in a legal decision in separation, divorce, declaration of annulment of marriage, filiation or alimony processes by means of the payment of an amount that will be regarded as an advance.

«Alimony» is taken to mean everything that is indispensable for sustenance, accommodation, clothing, medical assistance and education (article 142 of the Civil Code).

Eligibility for advances from the Fund is conditioned to alimony recognised through a sentence from the Spanish Cour.
